Introduction

Welcome to Aurum Infusion and Wellness Spa (“the Service Provider”), your premier destination for urgent care services. By accessing or using our services, either online or in person, you (“the User”) agree to be bound by these Terms of Use. These Terms govern your access to and use of our services, and by engaging with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms as well as our Privacy Policy.

These Terms of Use apply to all users of our services, including browsers, vendors, customers, merchants, and contributors of content. If you do not agree to all the terms and conditions, you may not access the website or use any services. Your agreement with us includes these Terms of Use and our Privacy Policy (“Agreement”).

Please review these Terms carefully before accessing or using our services. Your use of our services is also subject to our Privacy Policy, which explains how we collect, use, share, and store your personal information.

Acceptance of Terms

This Agreement sets the legally binding terms and conditions for your use of the services. If you do not agree, you must not access or use the services. The Service Provider may modify or replace these terms at any time at its sole discretion. Continued use after such changes constitutes your acceptance of the new terms.

Modification of Terms

The Service Provider may modify these Terms of Use at any time. If a revision is material, the Service Provider will provide at least 30 days’ notice before new terms take effect. What constitutes a material change is determined solely by the Service Provider.

By continuing to access or use the services after revisions become effective, you agree to the updated terms. If you do not agree, you are no longer authorized to use the services.

User Eligibility

This Agreement is only valid between the Service Provider and individuals at least 18 years of age. By using the services, you represent that you are at least 18 and have the legal capacity to enter into this Agreement. Users under 18 are prohibited from accessing or using the services and must stop immediately. This Agreement is void where prohibited by law.

Provision of Services

The Service Provider offers urgent care services for non-life-threatening injuries and illnesses that require prompt treatment, such as minor cuts, sprains, cold and flu symptoms, minor burns, and other acute conditions.

Users must schedule appointments and comply with pre-service requirements, which may include a health screening and consent to treatment. The Service Provider may refuse service based on medical considerations or failure to meet requirements.

Urgent care services are administered by qualified healthcare professionals, and the Service Provider maintains high hygiene and safety standards. Services may change based on availability, regulations, or other operational factors.

User Obligations

By accessing or using the services, Users agree to:

  • Maintain confidentiality of account information, user IDs, and passwords

  • Provide accurate, current, and complete information

  • Refrain from impersonating others or misrepresenting identity or affiliation

  • Avoid illegal or prohibited use under local, state, national, or international laws

  • Not transmit defamatory, offensive, harassing, violent, hateful, or objectionable material

  • Acknowledge the Service Provider’s right to refuse service, terminate accounts, remove content, or cancel orders at its discretion

Failure to comply may result in suspension or termination of access.

Intellectual Property Rights

All intellectual property rights — including copyrights, trademarks, service marks, patents, trade secrets, and proprietary materials — associated with the Service Provider’s content and services remain the exclusive property of the Service Provider or its licensors.

Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the services for personal, non-commercial purposes. Users may not modify, copy, reproduce, distribute, publish, create derivative works from, or exploit any intellectual property without written consent from the Service Provider.

Unauthorized use may lead to legal action.

User Content

By submitting content through the services, the User grants the Service Provider a worldwide, non-exclusive, royalty-free license (with sublicensing rights) to use, copy, reproduce, adapt, publish, display, and distribute such content in any medium.

The User represents that they own or have rights to the content submitted. Users agree to indemnify the Service Provider against claims resulting from content they provide.

The Service Provider may remove content at any time without notice.

Prohibited Conduct

Users agree not to:

  • Violate any laws or regulations

  • Access services through unauthorized means

  • Transmit viruses or harmful code

  • Interfere with or disrupt systems or networks

  • Copy, sell, or exploit services without written permission

  • Infringe intellectual property rights

  • Transmit unlawful, harmful, or offensive content

  • Impersonate individuals or misrepresent affiliations

The Service Provider may determine what constitutes unacceptable conduct and take appropriate action.

Disclaimer of Warranties

The services are provided “AS IS” without warranties of any kind, express or implied. The Service Provider disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

The Service Provider does not warrant that services will be uninterrupted or error-free, nor that servers or systems are free from harmful components.

Use of the services is at the User’s sole risk.

Limitation of Liability

To the fullest extent permitted by law, the Service Provider shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, goodwill, data, or other intangible losses.

The Service Provider’s total liability shall not exceed the amount paid by the User for services in the 12 months prior to the claim.

Indemnification

Users agree to indemnify the Service Provider against all losses, damages, expenses, and costs (including attorney fees) resulting from violations of this Agreement or misuse of the services.

This obligation survives termination.

Termination

Both the User and Service Provider may terminate this Agreement at any time.

Upon termination, the User must stop using the services and destroy any materials obtained through them.

Certain provisions (e.g., intellectual property, indemnification, dispute resolution) survive termination.

Governing Law

This Agreement is governed by the laws of Pennsylvania. All legal actions shall be brought exclusively in courts located in Pennsylvania.

Dispute Resolution

Disputes shall be resolved through arbitration in Pennsylvania before one arbitrator under JAMS Comprehensive Arbitration Rules.

Arbitration is limited to individual claims; no class actions or representative actions are permitted.

Miscellaneous

If any provision is deemed invalid, it will be modified minimally to remain enforceable. Remaining terms remain in effect.

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements.
